By accessing or using WRLDS ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and WRLDS Inc. regarding your use of the Service. By creating an account, accessing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

WRLDS is a platform that allows users to create, customize, and share 3D interactive worlds. The Service includes:

• 3D world creation and customization tools
• Social link aggregation and sharing features
• Character customization and avatar creation
• Analytics and visitor tracking (for premium users)
• Community features and content sharing

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information

• Provisions of these Terms that by their nature should survive termination shall survive

4. User Content

4.1 Content Ownership

You retain all ownership rights to the content you create, upload, or display on the Service ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service.

4.2 Content Restrictions

You agree not to post, upload, or share any User Content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy

5. Subscriptions and Payments

5.1 Subscription Plans

We offer both free and paid subscription plans. Paid plans ("Premium") provide additional features as described on our pricing page.

5.2 Payment Terms

• All payments are processed securely through Stripe
• You agree to provide current, complete, and accurate billing information
• Subscription fees are billed in advance on a monthly basis
• All fees are non-refundable except as required by law or as explicitly stated

5.3 Cancellation

You may cancel your subscription at any time. Upon cancellation:

• You will continue to have access to premium features until the end of your billing period
• Your account will revert to the free tier at the end of the billing period
• No refunds will be provided for partial months

5.4 Price Changes

We reserve the right to change subscription fees at any time. Any price changes will take effect at the start of the next billing period after notice is provided to you.

6. Prohibited Conduct

In addition to the content restrictions above, you agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to any portion of the Service
• Interfere with or disrupt the Service or servers
• Use any automated system to access the Service ("bots", "scrapers")
• Harvest or collect user information without consent
• Circumvent any security measures or access controls
• Resell, sublicense, or commercialize the Service without authorization
• Use the Service to compete with us or create a similar service

7. Intellectual Property Rights

7.1 Service IP

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of WRLDS Inc. and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written permission.

7.2 Feedback

Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without restriction or compensation to you.

8. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for:

• The content, privacy policies, or practices of any third-party websites
• Any damages or losses caused by your use of third-party services
• Any transactions between you and third-party providers

8.1 Third-Party Advertising

The Service displays advertisements from third-party advertising networks to users on the free tier within minigames. These advertisements are provided by independent advertising partners and do not constitute an endorsement by WRLDS of any product, service, or company advertised.

Third-party advertising partners may use cookies, web beacons, and similar technologies to collect information for the purpose of serving relevant advertisements. Their data collection practices are governed by their own privacy policies, not ours.

Premium subscribers are exempt from all third-party advertising. By using the free tier of the Service, you consent to the display of advertisements and the associated data collection by our advertising partners as described in our Privacy Policy.

WRLDS is not responsible for the content of third-party advertisements or for any claims, damages, or losses arising from your interaction with advertised products or services.

9. Disclaimers and Limitation of Liability

9.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• Any errors in the Service will be corrected
• The Service is free of viruses or other harmful components
• The results of using the Service will meet your requirements

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WRLDS INC., ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or goodwill
• Any damages arising from your access to or use of (or inability to access or use) the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to defend, indemnify, and hold harmless WRLDS Inc., its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your User Content
• Your use of the Service
• Your violation of any third-party rights

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by:

• Posting the updated Terms on our website
• Sending an email to your registered email address
• Displaying a notice within the Service

Your continued use of the Service after any changes constitutes acceptance of the new Terms.

13. Severability
